How Is THCa Federally Legal?
Under the 2018 Farm Bill, hemp is defined as Cannabis sativa L. and all derivatives of the plant — including its cannabinoids, extracts, and acids — that contain no more than 0.3% Δ9-THC (Delta-9 Tetrahydrocannabinol) on a dry weight basis. Because THCA (tetrahydrocannabinolic acid) is a naturally occurring, non-psychoactive cannabinoid that only converts into Delta-9 THC when heated (a process called decarboxylation), it is considered hemp-derived and federally legal as long as the product remains below the 0.3% Δ9-THC limit.
However, once THCA is heated — such as through smoking or vaping — it can convert into psychoactive THC, which may be subject to state-specific regulations. For this reason, it’s important to always follow your local laws when purchasing or using THCA products.
